Terms and Conditions

1 Definitions

In these Terms the following defined terms will always have the meanings given to them in this section 1:

Advertised Purchase Price’ means the Promoter’s full asking price for the Purchase of a Qualifying Property.

Assurance’ means a contractual warranty: a statement as to the existence of a state of affairs or circumstance which is true.

Closing Date’ means the last time at which reservations of Qualifying Properties can be accepted.

Opening Date’ means the first time at which reservations of Qualifying Properties can be accepted.

Purchase’ means the purchase of a Qualifying Property reserved during the period of the Promotion.

Purchaser’ means any person or group of people reserving and subsequently purchasing a Qualifying Property.

Promoter’ means Delph Properties Manchester 1 Limited of 44-45 Great Marlborough Street, London W1F 7JL.

Promotion’ means the “Furnish your new home on us” offer offered by the Promoter through its Agent.

Qualifying Property’ means a property with at least 2 bedrooms, bought at the Advertised Purchase Price, located in the building to be opened at 6 Cheetham Hill Road, Manchester M4 4FZ which is to be known as ‘The Hallmark’.

Reserving’, ‘Reserved’ or ‘Reservation’ refers to a commitment on the part of the Purchaser to Purchase a Qualifying Property from us.

Terms’ means these Terms of the “Furnish your new home on us” promotion.

us’, ‘we’ and ‘our’ means the Promoter and/or the Agent. ‘you’ and ‘your’ means the Purchaser.

1.1 Any term defined in this section has the same meaning throughout these Terms, whether expressed in its singular or plural form

2. Qualifying Purchases

2.1 Purchases must be Reserved during the period of the Promotion which is between the Opening Date of 09.00 hours on 10 September 2018 and the Closing Date of 17.00 hours on 30 November 2018.

2.2 Unless otherwise clearly stated then Purchases will only be accepted from Purchasers who are residents of the United Kingdom of Great Britain and Northern Ireland.

2.3 You may be asked to provide a valid passport, driving license or other form of photographic identification to give us Assurance that you fulfil this specific requirement.

2.4 If you cannot provide us with the proof we, acting reasonably and in our sole discretion require, then we reserve the right to disqualify your Purchase.

2.5 You must be 18 years old to Purchase. By Purchasing you give us your Assurance that you are no less than 18 years old.

2.6 The Promoter does not offer the Promotion to corporate or company Purchasers. Any Purchase must be made by a natural person buying a Qualifying Property on their own behalf or on behalf of another valid Purchaser (i.e. another UK Resident aged 18 or over).

2.7 We reserve the right to disqualify any Purchase which we in our sole discretion have reason to believe is ineligible for any reason or none.

2.8 Reservations received after the Closing Date will not be eligible for the promotion.

2.9 We do not accept responsibility for anything that you submit to us which may be lost in transit or in the post. Please keep a copy of anything you wish to retain for your own records or further use.

3 Claiming the benefit

3.1 Once your Reservation has been received you will be expected to exchange your Purchase within 28 days in order to claim the benefit available under these Terms.

3.2 Any failure by you to complete your Purchase within the time period stated under Term 3.1 will disqualify your claim to the benefit available under the Promotion. This notwithstanding, the Promoter may in its sole discretion decide to make the benefit available to you irrespective of any such failure.

3.3 The benefit is a sum of £12,000 payable as an allowance upon completion of the Purchase of a Qualifying Property Reserved during the period of the Promotion for which the Purchaser pays the Advertised Purchase Price.

3.4 No other form of benefit or payment is offered or will be made available.

4 Other Terms

4.1 These Terms form no part of any contract of property purchase and are specific to the Promotion.

4.2 By Reserving a Qualifying Property and providing us with the information we require, you agree to be bound by and, accept these Terms.

4.3 We reserve the right in our sole discretion, acting reasonably to cancel the Promotion or to change these Terms at any time if a change is required due to circumstances beyond our control. Any change will be an amendment to these Terms and will amend the agreement between you and us in relation to the Promotion.

4.4 Any use of your personal information in relation to the Promotion will be in accordance with the privacy policy of the Promoter and data protection laws.

4.5 If a dispute arises between you and us at any time regarding the Terms, conduct, or application of the Promotion then our decision will be final and no further debate or correspondence will be entered into.

4.6 These Terms are governed by and, in the event of dispute will be construed and interpreted in accordance with the laws of England and you and we submit to the exclusive jurisdiction of the English courts to resolve any dispute which cannot easily be resolved by you and us.
